The right for Kiwis to appeal to the Privy Council was abolished by Labour from 1 January 2004. At the time there were calls for a public referendum as it should have been a right of citizens to have a say over such a major constitutional issue. However this was ignored by Labour in the face of opposition and critism, a pattern that has been repeated over recent years.

 

On 9 October 2003 the NZ Herald Editorial wrote:

"To pass [the Supreme Court Bill] into law would be an act of breathtaking arrogance. To assume that a wafer-thin majority is sufficient to enact fundamental changes to the legal and constitutional fabric of New Zealand is nothing short of an abuse of power."
